1. Acceptance of Terms

• You are at least 18, or using the website under parental supervision
• You have the legal capacity to enter into a binding contract
• You will use the website in accordance with these Terms
• All information you provide is accurate, current, and complete
• You are located in India or an area we service

2. Account Registration

To make purchases you may need to create an account. You are responsible for all activity under your account, for keeping your password confidential, and for notifying us immediately of any unauthorized access.

We may suspend or terminate your account for violations of these Terms, fraudulent activity, abuse of our return policies, or extended inactivity (2+ years, with prior notice).

3. Use of Website

Permitted Use

• Browse products and make legitimate personal purchases
• Contact customer support and access your account
• Read content and resources we provide

Prohibited Use

• Unlawful use, impersonation, or unauthorized system access
• Transmitting viruses or using bots/scrapers
• Copying our content, images, or branding without permission
• Posting false reviews or manipulating ratings
• Reselling our products commercially without authorization

4. Intellectual Property

All content on our website — product images, descriptions, logo, brand name, design, code, and marketing materials — is owned by Devaira Collective and protected by copyright, trademark, and other intellectual property laws. Unauthorized use may result in legal action.

5. Product Information & Pricing

All prices are listed in Indian Rupees (INR) and include applicable GST. Price at checkout is final. We reserve the right to change prices, correct pricing errors, and cancel orders placed with incorrect pricing (with full refund).

Colors and measurements may vary slightly due to screen settings and photography. Products are subject to availability. If an item becomes unavailable after you order, we'll notify you and offer alternatives or a full refund.

6. Ordering and Payment

When you place an order you're making an offer to purchase at the listed price. Acceptance occurs when we ship the order and send shipping confirmation. We may refuse orders for unavailable products, pricing errors, suspected fraud, declined payment, or unserviceable addresses.

• UPI (Google Pay, PhonePe, Paytm, etc.)
• Net banking and digital wallets
• Cash on Delivery for orders up to ₹15,000 (₹75 COD fee)

7. Shipping & Delivery

We ship to serviceable pin codes across India. Processing takes 1-3 business days; metro delivery in 3-5 days, other areas 5-10 days. Orders above ₹999 ship free; below ₹999 incur ₹99 shipping. Risk of loss transfers to you upon delivery. See our Shipping Policy for complete terms.

8. Returns, Refunds, and Exchanges

You have 7 days from delivery to initiate a return. Items must be unworn, unwashed, with tags attached and in original packaging. Innerwear, swimwear, final-sale items, and customized products are not returnable.

• Prepaid refunds: 5-7 business days after approval
• COD refunds: 7-10 business days (₹99 reverse-pickup fee deducted)
• We do not offer direct exchanges — return and place a new order

9. Warranties & Limitation of Liability

Our products are warranted to be new, to match their description (allowing for minor variations), and to be free from manufacturing defects at delivery. Our website and products are otherwise provided "as is" without further warranties.

To the maximum extent permitted by law, our total liability for any claim arising from your purchase shall not exceed the amount paid for the specific product giving rise to the claim.

10. User-Generated Content

By posting reviews, ratings, or feedback, you grant us a perpetual, royalty-free license to use, reproduce, and display your content. You represent the content is original, based on genuine experience, and free of offensive or infringing material. We may remove, edit, or decline to publish any content at our discretion.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of Indian courts. We encourage you to resolve issues through:

1. Customer support at support@devaira.in
2. Escalation to our Grievance Officer within 30 days
3. Binding arbitration under the Arbitration and Conciliation Act, 1996
4. Legal action in Indian courts, if required

You agree to resolve disputes on an individual basis and waive the right to class-action lawsuits.

12. Termination

You may close your account at any time. We may suspend or terminate your access for breach of these Terms, fraudulent activity, policy abuse, or if required by law. Pending orders will be fulfilled unless cancelled. Provisions that by nature should survive termination (warranties, liability limits, IP, governing law) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or a website banner, and the Effective Date above will be revised. Continued use of our website after changes constitutes acceptance.
